Zoning Board of Appeals Minutes May 16, 2007
MEMBERS PRESENT: Peter Conner, William Keohan, Michael Main, David Peck, A. Wendy Longo and Robert Richard.

MEMBER ABSENT: Marc Betti

Mr. Conner called the meeting to order and explained procedures for the evening.

CASE NO. 3418– SCOTT FREDRICKSON and CRAIG RICHARDS – WEST LONG POND ROAD

Sitting: Peter Conner, David Peck, A. Wendy Longo, Robert Richard, and William Keohan.

Mr. Richard read the legal advertisement into the record.

Mr. Conner acknowledged receipt of two letters of support received in the ZBA office.

Mr. Flaherty, Flaherty & Stefani, representing the petitioner, said the lot is approximately 38,000-sq. ft. The Wildlands Trust owns the land across the street.  Natural Heritage will be contacted for approval.  The sight distance is excellent.  

Mr. Richard asked the petitioner if there would be utilities in the garage.

Mr. Flaherty replied electricity only.

CASE NO. 3419 – JEAN A. SWEENEY – BAY VIEW AVENUE

Sitting: Peter Conner, William Keohan, David Peck, A. Wendy Longo, and Robert Richard.

Mr. Richard read the legal advertisement into the record.

Mr. Parker, Land Management Systems, representing the petitioner, said the lot is 36,000-sq. ft. in the R20SL zone a duplex could be constructed by right.  The petitioner would prefer to create a 15,000-sq. ft. lot under the special permit process.  The road is paved with a sidewalk.  The area has Town water and sewer.

CASE NO. 3420 – PHILLIP and SUZANNE CORREA IRREVOCABLE LIVING TRUST – SEVEN HILLS ROAD

Sitting: Peter Conner, William Keohan, David Peck, A. Wendy Longo, and Robert Richard.

Mr. Richard read the legal advertisement into the record.

Mr. Parker, Land Management Systems, representing the petitioner, said Seven Hills is a major road.  The land consists of 60,000-sq. ft. ± and was purchased in 1963.  A common driveway will be used. Several different scenarios were displayed for the Board members.  The petitioner has options of creating a subdivision to create the additional lot.

Mr. Richard made a motion to approve Case No. 3419 with conditions.

Mr. Peck seconded.

CASE NO. 3420 – PHILLIP and SUZANNE CORREA IRREVOCABLE LIVING TRUST – SEVEN HILLS ROAD

Mr. Richard made a motion to approve Case No. 3420.

Mrs. Longo seconded.

2-3 (Mr. Conner, Mr. Peck aand Mr. Richard opposed).

Denied.

Mr. Hartmann reviewed the Regulatory Agreement for Benway (Pineknoll) on Bourne Road.  Counsel has advised that the Regulatory Agreement and the Comprehensive Permit conflict with each other.  The Board agreed to send the agreement back for correction.

No further business came before the Board.
